Five judges are elected every three years and serve for nine years. This time, the contest was deadlocked.

"We are naturally disappointed, but it was a competitive field with six strong candidates". "We congratulate Judge Dalveer Bhandari of India for his re-election to the ICJ, as well as the other candidates who were elected or re-elected", a state department spokesperson said.

Swaraj had added that an expansion in the Permanent and non-Permanent membership of the Council to reflect contemporary realities was an urgent necessity.

The permanent members of the Security Council - the US, Russia, France and China - were understood to have been throwing their weight behind Greenwood.

The 15-member ICJ is the UN's top judicial organ that settles disputes between countries.

India has been seeking that the democratic process need to be played its full course in both the Security Council and the General Assembly and there should not be an intervention or adoption of a process that has never been used before or the one that undermines the voice of the majority. Commenting on the British action, it said, "The UK chose to withdraw its candidate after a closely fought electoral process".

In addition, the only other Asian candidate besides Justice Bhandari was Mr. Salam, who had been the Lebanese Ambassador to the United Nations since 2007, and was a well known figure.

After the previous 11 rounds of voting produced a stalemate, with the 193-member General Assembly solidly rallying behind Bhandari and the 15-member Security Council backing Greenwood, all eyes were on Monday's voting to see if the pattern would be broken and a clear outcome thrown up. But with a rather heavy heart.

The official added that the USA remained opposed to any adjustment or expansion of the veto power enjoyed by the permanent members of the UN Security Council.

The US congratulated India as well.

"The decision to bow to mounting opposition within the United Nations general assembly is a humiliating blow to British global prestige and an acceptance of a diminished status in worldwide affairs".

After former Navy official Kulbhushan Jadhav's case, now on death row in Pakistan, reached the ICJ, there was an understanding that having an Indian nominee in the ICJ was a priority. The next hearing is in December.

Swaraj, who led an Indian delegation to the UNGA annual session, stayed in NY in September for seven days to canvass support for Justice Bhandari.

Rycroft said that the United Kingdom will continue to support the work of the ICJ, "in line with our commitment to the importance of the rule of law in the UN system and in the worldwide community more generally".

For a victory, it was necessary to get majority support both at the UN General Assembly (UNGA) as well as at the UNSC. India won against a P5 member by vote.

The old order is changing.
