The constitution requires a losing presidential candidate to file a challenge within seven days of a victor being declared.

The electoral commission declared the Zanu-PF's Emmerson Mnangagwa had 50.8% of votes against the MDC Alliance's Nelson Chamisa's 44.3%.

MDC Alliance has missed the 4pm deadline today to file the court case to challenge the presidential election results. If it does this successfully, the court could order a recount or nullify the result altogether.

The court will have 14 days to make a ruling on the case.

The day before the protests - and before the final presidential results were announced - Biti held a press conference at the Movement for Democratic Change (MDC) headquarters in Harare, claiming victory for the party.

Mr Chamisa wants the court to declare him the victor or call a fresh election, his lawyer told Reuters news agency on Friday.

The Zimbabwe elections body, ZEC, declared Mnangagwa victor of the hotly contested polls with 50.8% of valid votes cast.

The first election since Robert Mugabe was forced to resign after a coup in November had been expected to end Zimbabwe's pariah status and launch an economic recovery but post-election unrest has reminded the country of its violent past.

In the days following the poll, six opposition supporters died in clashes with the army, which has led some to question about its neutrality.

Mr Mnangagwa has appealed for peace and promised an independent investigation into the post-election violence.

Despite the contentious election result, the state-owned Herald newspaper has reported that President-elect Emmerson Mnangwagwa will be inaugurated on Sunday, 12 August.

Zambia's government rejected Mr Biti's request for asylum, and on Thursday he was released on $5,000 (£4,300) bail and ordered to surrender his passport.

Zambia risks losing aid from the United States government following the forced deportation of Zimbabwean opposition politician Tendai Biti.
