Chief Justice Roberts sends Kavanaugh complaints to Colorado court

  • President Donald Trump listens as retired Supreme Court Justice Anthony Kennedy swears-in Supreme Court Justice Brett Kavanaugh

Garland had been nominated to the Supreme Court by President Barack Obama, but Senate Republicans never acted on the nomination.

He was sworn in on Saturday by Chief Justice John Roberts and former associate justice Anthony Kennedy, for whom he clerked 25 years ago. He added Monday that the fight over Kavanaugh, particularly that his nomination was stymied by unproven allegations, injected the GOP with an "adrenaline shot that we had not been able to figure out how to achieve in any other way".

Sens. Chuck Grassley and Mitch McConnell disagree on whether the GOP would try to confirm a Supreme Court justice in a presidential election year, something they prevented Democrats from doing in 2016. The judges may be forced to conclude "that intervening events have rendered the allegations moot or make remedial action impossible", said Arthur Hellman, an ethics professor at the University of Pittsburgh.

Kavanaugh was confirmed by a razor-thin 50-48 majority in the U.S. Senate following accusations of sexual misconduct, including one of sexual assault as a high-schooler, that he emphatically denied. "The complaints seek investigations only of the public statements he has made as a nominee to the Supreme Court of the United States".

The specifics of the complaints remain unknown, but people familiar with the matter say that they accuse Kavanaugh of misleading the public, and criticize his attitude and lack of political impartiality during his confirmation hearings.

The judiciary's rules allow members of the public to lodge complaints about federal judges.

Each federal court has a so-called "judicial council" to investigate conduct complaints and make disciplinary recommendations.

Last weekend DC Circuit Judge Karen LeCraft Henderson mentioned the complaints in a news release.

President Trump has praised his US Supreme Court pick.

Roberts referred the case to the appeals court in New York City.
