Google on Tuesday filed an appeal of a $5 billion fine imposed by the European Commission over antitrust violations related to the company's Android mobile operating system.

Back in July, the European Commission fined Google for its restrictions on Android device makers and network operators, charging the restrictions were meant to "cement its dominant position in general internet search".

Now the company has filed an appeal for the decision, according to the Wall Street Journal, but has also importantly said it has no plans to ask for so-called interim measures to pause application of the decision.

EU Competition Commissioner Margrethe Vestager ordered Google to "put an effective end to this conduct within 90 days or face penalty payments" of up to 5 per cent of its average daily turnover. These practices have denied rivals the chance to innovate and compete on the merits. Ms Vestager described any such action as "a trojan horse" implying that the European Union would come down harshly if such a workaround was in use.

In its July decision, Brussels accused Google of using the Android system's huge popularity on smartphones and tablets to promote the use of its own Google search engine and shut out rivals. Google refuted this, claiming that "Android has created more choice for everyone, not less" by licensing its operating system for free.

The decision was made following two years-worth of investigation surrounding Google's Android practices.

Google's lawyers could be hard at work for years to come battling the decision, as the firm tells Reuters that it has "now filed our appeal of the EC's Android decision at the General Court of the European Union".
