Manhattan's district attorney has dropped part of the criminal case against disgraced movie mogul Harvey Weinstein. He previously pleaded not guilty to six felony sex crimes, stemming from allegations brought forward by three women.
The Sept. 12 letter from Assistant District Attorney Joan Illuzzi-Orbon to defense lawyer Ben Brafman was filed under a protective order, which Justice James Burke lifted Thursday.
"In short, your honor, we are moving full steam ahead", she said.
Goldberg added that despite District Attorney Cy Vance not opposing the motion to dismiss the charge against Weinstein, her client's claims remain and this "does speak to a system desperate in need of reform". The five remaining charges include predatory sexual assault, criminal sexual act in the first degree, rape in the first degree and rape in the third degree.
"We know of no evidence refuting our client's report that Harvey Weinstein forcefully sexually assaulted her", she said in a statement.
Weinstein's defence lawyer later suggested, outside court, that Ms Evans should be criminally prosecuted for perjury.
Sometime later, Evans told the pal that she had gone to Weinstein's office "where the Defendant told her, in substance, that he would arrange for the Complainant to receive an acting job if she agreed to perform oral sex upon him". Evans has denied the account, according to a D.A.'s letter, asserting that she never exposed her breasts to Weinstein or gave him oral sex. At the time, she was a 21-year-old student and aspiring actress.
She insisted Evans has told the truth and disputed that she either showed Weinstein her breasts or misled investigators.
