Netflix faces $25 million lawsuit over Black Mirror: Bandersnatch

Indeed, the phrase "choose your own adventure" has been nearly inextricably linked to Bandersnatch, either through Netflix's own efforts or the mark's ubiquity as established by Chooseco.

The streaming titan has been slapped with a lawsuit from Chooseco LLC, the company that has been using the "Choose Your Own Adventure" trademark since the '80s, selling over 260 million books that utilize the title and interactive storytelling format. The suit mentions that Netflix attempted to secure a license to use the Choose Your Own Adventure trademark over the last few years, but a deal was never officially made.

Moreover, Chooseco's filing revealed that as far back as 2016, Netflix had entered into discussions with the publisher over the possibility of obtaining a license that would have put them legally in the clear to use the "Choose Your Own Adventure" brand as a plot hook.

The popular "Black Mirror: Bandersnatch" episode debuted December 28 and allows viewers to select how they want the story to go and get different endings. The suit alleges that Netflix "intentionally and willfully used Chooseco's famous mark in order to benefit from the positive associations with - and nostalgia for - the brand by adults who read the series as youngsters", according to Deadline.

According to the suit, Netflix apparently tried to obtain a license for Chooseco's trademark in the past, but wasn't able to reach a deal with the publisher.

The suit also notes that 20th Century Fox recently optioned the rights to create a film based on the series, which is now in the works.

"We would prefer not to resort to litigation, but given the damage that we will suffer as a result of the use of our mark we've been left with no other option", Chooseco co-founder and publisher Shannon Gilligan said in a press release.

Netflix, which has avoided using the phrase "choose your own adventure" in advertising, is yet to comment publicly on the case. The popular book series sent children on many fantastical adventures, like time travel through space or in search of the abominable snowman. The suit claims infringement, dilution and unfair competition and Chooseco is seeking at least $25m in damages or profits, whichever is higher.
