Netflix Sued by 'Choose Your Own Adventure' Over 'Bandersnatch'

The streaming platform released the feature-length Bandersnatch in December which allowed viewers to make decisions at various points of the story, affecting what outcome they might then encounter.

After R.A. Montgomery, the original publisher and author of the "Choose Your Own Adventure" series, passed away in 2014, his widow Shannon Gilligan took over the company.

According to Variety, Chooseco LLC, the Vermont-based publisher of the book series, claims Netflix "exploited the brand awareness of the book series to launch the show". "Chooseco and Netflix engaged in extensive negotiations that were ongoing for a number of years, but Netflix did not receive a license".

He proposed expanding state-funded health care to low-income people living in the county illegally until the age of 26. He also plans to increase funding to provide full-day preschool and kindergarten to all children.

According to the suit, Netflix apparently tried to obtain a license for Chooseco's trademark in the past, but wasn't able to reach a deal with the publisher. Also, the lawsuit notes that Chooseco sent Netflix a cease and desist request asking the service to stop using Choose Your Own Adventure in connection with its marketing efforts for one of its earlier interactive children's programs. The film gets bloody and violent, which is part of the reason Chooseco has chosen to sue, claiming the disturbing nature is inappropriate for young readers and that the adult imagery "tarnishes" the Choose Your Own Adventure brand.

Chooseco is seeking $25 million or more in damages. "We would prefer not to resort to litigation, but given the damage that we will suffer as a result of the use of our mark we've been left with no other option".

The company had already partnered with Twentieth Century Fox for an upcoming series of interactive films based on the books, which have sold over 265m copies worldwide. While describing his Bandersnatch video game - which is an allegory for the film as a whole - main character Stefan says, "It's a "Choose Your Own Adventure" book".
