Two-year-old Bulger was tortured and killed by 10-year-olds Robert Thompson and Jon Venables in Liverpool in 1993, in what became one of Britain's most notorious crimes and subsequent murder trials.
The paid snatched James Bulger from outside a butcher's shop in Bootle, Merseyside, in 1993, while his mother popped into a store for just a few seconds.
The film recreates the moments before and after the murder and is based on transcripts of the police interviews with Venables and Thompson.
In a statement posted on Twitter, Fergus said she was "disgusted and upset" that the Academy had chosen to honour the film, which was made without the family's permission.
Fergus had previously spoken out about the film on UK TV's Loose Women earlier this month, saying she won't watch it because "I don't want to keep going back there all the time".
"After everything I've said about this so called film and asking for it to be removed, it's still been nominated for an Oscar".

In an interview with BBC News, he added: "I wouldn't expect them to be comfortable with a film which humanises the boys but I do hope they understand the reason it was made, and it certainly wasn't to bring any more grief to them".
