The New York state Senate took a another step towards revealing President Trump's state tax returns, passing a bill on Wednesday which would require the release of any state tax returns requested by the chair of the federal House Ways and Means Committee, the Senate Finance Committee, or the Joint Committee on Taxation.
The TRUST Act passed the state senate by a 39 to 21 vote and Gov. Andrew Cuomo, a Democrat, has said he will sign it. She's running for president and represents MA in the U.S. Senate.
It would include filings related to personal income taxes, real estate taxes and corporate income taxes and cover up to five years of returns before the person took office.
"What has happened this week in Washington makes it all more important that the state of NY steps into the constitutional void and provides Congress with what it's entitled to know, in this case the tax return of the president", said Sen. Earlier this week, Treasury Secretary Steve Mnuchin refused to honor the House's legally binding (in the view of most scholars) request to turn over six years of Donald Trump's tax returns, arguing that Congress lacked "a legitimate legislative purpose" for soliciting those documents.
Warren, a Democratic presidential candidate, has been drawn into the debate over the bill because she sponsored a previous piece of legislation regarding the reservation, and her now famous claims of Native American heritage.
Trump's home state is NY, where many of his business enterprises are based. Any law passed in NY might also be destined for a court challenge. The bill is scheduled to return to the floor next week, but out of sight of the public (and, they hope, the president).
The escalating clash between House Democrats and the White House over Trump's taxes follows a bombshell report from The New York Times that found Trump had lost more than a $1 billion from his core business ventures like casinos, hotels, and retail spaces from 1985 to 1994.
The measure, which would amend state laws prohibiting private tax information from being released, isn't scheduled for a vote yet in the state Assembly, where more than 90 Democrats in the 150-seat chamber support the legislation.
"The claim that NY can't give Trump's returns to Ways and Means is really, really, really weak", Daniel Hemel, a professor at the University of Chicago, told the paper. While no companion bill has been introduced in the Senate, Trump and other Republicans leaders have publicly tied the resolution to Warren.
This story has been corrected to show the bill applies to all New Yorkers, not just seven types of state and federal officeholders.
"No matter how they dress it up for legal purposes ... and they're trying different wordings to do it, this is aimed at one individual, the president of the United States, with the objective of re-litigating the 2016 campaign in which the people of the United States knew that he had not released his tax returns and they still elected him president of the United States", Cox said.
"We urge Assembly members to send this bill to Governor Cuomo's desk and ensure that Donald Trump's numerous conflicts of interest come to light".
