SC quashes plea against Padmavati's release outside India

While dismissing the petition, a three-judge bench, headed by Chief Justice of India (CJI) Dipak Misra, observed that when the matter is pending consideration of the Central Board of Film Certification (CBFC), how can persons holding public offices comment on whether the CBFC should issue certificate or not?

The Supreme Court, while hearing the plea filed by lawyer Manohar Lal Sharma against Sanjay Leela Bhansali's film Padmavati, pulled up politicians for commenting on the movie without seeing it. It'll prejudice decision making of CBFC... All concerned people, holding responsible posts must be guided by rule of law and shouldn't venture into passing comments on films which haven't been cleared by CBFC. As per India Today, the court categorically reminded the politicians that the film has not been cleared by the Central Board of Certification - and the onus for whether or not the film should be passed lies with the board, and no one else.

The court also took a strong exception to statements made by persons holding high offices against the film, saying the remarks were tantamount to pre-judging the movie which is yet to be certified by the Censor Board. On November 20, the court had dismissed another petition by Sharma seeking deletion of some scenes from the film. Bhansali's magnum opus "Padmavati" has been in the eye of the storm following protests from various conservative groups over alleged tampering with historical facts, a contention which filmmaker Bhansali has denied repeatedly.

On Tuesday, Bihar Chief Minister Nitish Kumar sought "clarifications" before Padmavati was shown in the state, adding that the character of the queen should not have been shown dancing. The release of the film, which was earlier slated for December 1, was deferred as the filmmakers were yet to procure a censor certificate.
