The judge also issued a nationwide injunction on future family separations.

If children are younger than 5, they must be reunified within 14 days of the order issued Tuesday by US District Judge Dana Sabraw in San Diego.

Now, the policy of detaining parents who cross illegally with children has been suspended, with authorities saying that among other factors they do not have space for all the families coming over from Mexico.

After falsely blaming Democrats for the separations and insisting that only Congress could fix the issue, the president last week issued an executive order created to end the practice under his "zero tolerance" policy, which prosecutes adults who come to the US illegally. "This is a startling reality", the judge wrote. The government readily keeps track of personal property of detainees in criminal and immigration proceedings.

"Yet, the government has no system in place to keep track of, provide effective communication with, and promptly produce alien children", he continued.

Court rips into the US government for the "startling reality" that it has failed to have any process for keeping track of kids ripped apart from their parents & has done a worse job keeping track of children it jails than it does of "property". "Our position is it violates the Constitution, violates due process, violates equal protection and violates the Administrative Procedure Act".

"This is a complete victory for these families and children who have been suffering for months", said ACLU attorney Lee Gelernt.

Sanchez with the nonprofit Southwest Key Programs said in an interview with The Associated Press that the government has no process in place to speed the return of children to their parents. Still, about 2,000 children remain split from their parents. Her daughter cried each time they spoke over the phone, and Ms. L feared that they would never see each other again. That process usually takes a few weeks to a month, then they are taken into immigration custody for the civil deportation process to begin. "Numerous children are babies and toddlers who every night are crying themselves to sleep wondering if they will ever see their parents again".

It was a rare retreat for Trump, who has made fighting immigration - both illegal and legal - one of the most sacred mantras of his fiercely US-centred policy agenda.

HHS, which is in charge of the separated children, referred questions Wednesday to the Justice Department, which in turn said it was up to Congress to deal with the border situation.

The federal court said all children must be returned to their families within 30 days.

But President Trump reversed the order late last week after national, bipartisan outcry.

"Unless there is a determination that the parent is unfit or presents a danger to the child, or the parent affirmatively, knowingly, and voluntarily declines to be reunited with the child". Sabraw's injunction strongly suggests that he will side with the ACLU when he issues a final decision. The lawsuit does not seek to block the zero-tolerance prosecutions that were announced after the ACLU filed its lawsuit. "We have zero tolerance for people who enter our country illegally", Trump said after he signed the executive order.

Sabraw's preliminary injunction also requires the government to reunite children under the age of five with their parents within 14 days, and let children talk with their parents within 10 days.

Family integrity, Sabraw concluded, is a constitutional right.
