United States singer Katy Perry copied the beat of her 2013 hit Dark Horse from a Christian rap song, a Los Angeles jury found yesterday. The main focus of the copyright infringement case was about the beat, not the lyrics.

Perry's lawyer, Christine Lepera, countered by saying Gray and his team were "trying to own basic building blocks of music, the alphabet of music that should be available to everyone".

Gray's lawyers said the defendants had "copied an important part" of his song, referring to a 16-second instrumental phrase.

In denying Perry's motion for early judgment last summer, U.S. District Judge Christina Snyder wrote that the plaintiffs "have demonstrated a triable issue of fact as to access because "Joyful Noise" achieved critical success, including a Grammy nomination, and was readily available and viewed millions of times on YouTube and MySpace".

But the jury of six women and three men disagreed, finding that the bumping beat and riff at the centre of Joyful Noise were original enough to be copyrighted.

Gray's lawsuit was filed in 2014, the year after the release of Dark Horse, which became one of Katy Perry's biggest hits. According to Christian rap group, "Flame", the Firework singer copied their song entitled Joyful Noise.

Perry even testified herself on the first day of trial, recalling for 35 minutes on the stand how Dr. Luke and Cirkut brought her the instrumental track and that she had never heard "Joyful Noise" and the artists behind the song, ABC 7 reported. However, they managed to fix the glitches without Perry performing. "They're trying to shove Mr Gray into some gospel music alleyway that no one ever visits", argued Michael A Kahn. Perry's publicist did not immediately return an email message seeking comment Monday evening.

"I could perform it for you live".

Jurors heard both songs played back-to-back at the end of closing arguments this week.
