Former top Federal Bureau of Investigation official Andrew McCabe, who was dismissed from the agency following a tumultuous relationship with President Donald Trump, filed a lawsuit on Thursday alleging the termination violated his constitutional rights to free speech and due process.

Former Deputy FBI Director Andrew McCabe is suing the Trump administration, including Attorney General Bill Barr, the DOJ, the FBI, and FBI Director Chris Wray, for what he says was his "unlawful" termination past year.

Lawsuit claims "unlawful retaliation" for McCabe's "refusal to pledge allegiance" to Trump.

It says the government sped up disciplinary proceedings so McCabe could be fired ahead of his planned retirement and without receiving full benefits. He was turning 50 that weekend and served in the bureau for 21 years, making him eligible for his pension, health care coverage and other retirement benefits, the lawsuit says.

A fired FBI agent who had worked on the Russian Federation investigation, Peter Strzok, also sued the Justice Department earlier this week over his own termination, saying Trump had pressed for his firing in 2018 for political reasons.

Trump had torn into McCabe's wife's Democratic political ties after she had run for state senate in Virginia in 2015. Terry McAuliffe-a former Clinton campaign bundler and business partner of Hillary Clinton's brother-even as Andrew McCabe was supposed to be overseeing an investigation into Clinton.

Trump seized on the news, falsely claiming that McCabe oversaw the Clinton email investigation at the time the contributions were made and that McCabe had chose to close the FBI investigation into her without bringing charges.

The lawsuit also says President Trump "demanded" McCabe's "personal allegiance", and "sought retaliation" when McCabe refused.

White House officials did not immediately respond to a message seeking comment.

"Trump's purge targeted Plaintiff in particular because Trump had already decided during the 2016 USA presidential campaign that Plaintiff was his partisan enemy by virtue of Plaintiff's marriage", the lawsuit said.

McCabe, who briefly served as acting Federal Bureau of Investigation director after James Comey was sacked, has long defended his actions, insisting he did his best to relay accurate information to those investigators.

The inspector-general referred McCabe's case to the US Attorney's Office in Washington, which has been using a grand jury to determine if McCabe should also be charged criminally.

Mr McCabe has denied any wrongdoing, and said that when he felt his answers were being misunderstood, he tried to correct them.

McCabe has said those allegations were a pretext to get rid of him after months of abuse from President Trump, who had singled him out as a political scapegoat in the 2016 campaign.

McCabe said he was "singled out and treated this way because of the role I played, the actions I took, and the events I witnessed in the aftermath of the firing of James Comey", he said in a statement past year.

Former FBI Director James Comey is also believed to be facing severe scrutiny from the probes for his role in the alleged partisan collusion.
