La justice du Salvador jugeait à nouveau, à partir de jeudi, pour homicide, Evelyn Hernandez, une jeune femme qui a perdu son bébé, dans ce pays où la législation anti-IVG est l'une des plus strictes du monde.

"Le juge a été assez juste: il a dit qu'il n'y avait pas moyen de prouver le délit, et c'est pour cela qu'il a prononcé l'acquittement".

L'accusation avait réclamé contre la jeune femme une peine de 40 ans de prison pour homicide aggravé par négligence.

Après 33 mois d'emprisonnement, elle a été condamnée, en juillet 2017, à 30 ans de prison pour homicide aggravé avec préméditation.

"Acquittée! Oui, on a réussi", a écrit sur Twitter Bertha Maria Deleon, l'avocate d'Evelyn Hernandez, 21 ans, qui a toujours expliqué que le bébé était mort-né.

Une jeune Salvadorienne, Evelyn Hernandez, a été acquittée lundi du meurtre de son bébé mort-né, mais l'arsenal législatif et judiciaire qui réprime sévèrement l'avortement reste intact au Salvador. Ce premier jugement avait été cassé en février par la Cour suprême, et Evelyn Hernandez avait été libérée. "Cela prouve que le délit n'existait pas, qu'il n'y avait pas lieu d'engager des poursuites", a déclaré à la sortie du tribunal l'avocat Arnau Baulenas de l'Université jésuite centroaméricaine IDHUCA.

L'histoire de cette jeune femme est à peine croyable. Selon la défense, elle encourt 30 à 50 ans de prison. Elle encourait entre 30 et 50 ans de prison pour l'homicide de son bébé, selon les réquisitions du ministère public, lors du second procès qui se déroulait, la semaine dernière.

Elle est libre. Evelyne Hernandez, 21 ans, est devenue le symbole de la défense des droits des femmes au Salvador. Mais dernièrement, cinq femmes condamnées pour des cas identiques ont été remises en liberté.
