A federal judge Monday dealt a setback to President Trump's lawsuit to stop the state of NY from providing a congressional committee with his tax returns.
Judge Carl Nichols ruled that the case mostly involves NY state law, so his Washington, DC, court isn't the place to consider it.
Trump argued that any request made for his state tax returns under the TRUST Act, would violate the First Amendment of the U.S. Constitution, claiming the Act was specifically enacted to discriminate and retaliate against his politics and speech. His legal team has vowed to appeal the decision and said they will take the case all the way to the Supreme Court.
Nichols said Trump could sue NY officials in that state.
"Based on the current allegations, Mr. Trump has not met his burden of establishing personal jurisdiction over either of the NY defendants", Nichols wrote in a 19-page ruling. Trump had sued to block James from enforcing the new law and block Schmidt from providing the documents.
"Regarding the tax case out of DC - we are reviewing the opinion", Sekulow said.
"Based on the current allegations, Mr. Trump has not met his burden of establishing personal jurisdiction over either of the NY defendants", Judge Nichols wrote. Andrew Cuomo signed a law allowing the state to share information with the U.S. Congress.
NY law "was enacted to retaliate against the President because of his political positions, his political beliefs and his protected speech, including the positions he took during the 2016 campaign", Trump's lawyers said in a court presentation.
The lawsuit represents one of several court battles over Trump's tax returns.
Neal has demonstrated little interest in making use of the law though, to the consternation of many liberals, for fear that it could undermine his own separate lawsuit for Trump's federal returns.
Last week, an appeals court in NY ruled that Trump's accounting firm must deliver eight years of its tax returns to NY prosecutors.
Nichols's opinion came in a wave of litigation over the president's attempts to shield his personal finances from investigators, including congressional Democrats, state lawmakers and regulators.
"It's time for Congress to request them", said NY state Sen. The House Ways and Means Committee filed a lawsuit against the Trump administration seeking six years of the president's tax returns.
In a separate case, a federal appeals court ruled earlier this month that Trump's tax returns can be turned over to NY prosecutors by his personal accountant in response to a grand jury subpoena.
