The official promised an investigation after an outcry from people who assailed enforcement of a no-food rule as racist.
A BART police officer was caught on video last Monday detaining a man for eating a breakfast sandwich as he waited for his train to get to work; the video features the officer repeatedly telling the man, "You are detained and you are not free to go".
The transit agency's independent police auditor is investigating the incident and will report his findings to the BART police citizen review board, Powers said. "As a transportation system our concern with eating is related to the cleanliness of our stations and system", BART general manager Bob Powers said in the statement.
Six minutes into the video, after more back-and-forth between Gluckman and the officer, other BART officers show up and handcuff the man, the report said. He says that Foster "refused to provide identification, [and] cursed at and made homophobic slurs at the officer who remained calm through out the entire engagement". He tells Foster he is resisting arrest. When the officer walked by again and saw Foster still eating, he went to issue a citation.
"People should be able to eat on the platform without getting harassed", Ms. Groth said. "You're eating. It's against the law".
"I was just up there eating my sandwich waiting for the train to come", Foster explained to the station. "You singled me out of all of these people". He could face a $250 fine or 48 hours of community service, a BART spokeswoman said.

"To see yet another young black man impacted by law enforcement like this is extremely troubling to me", Li told the paper.
"For me, there are WAY bigger issues at BART than enforcing no drinking/eating", she wrote.
A video of the incident went viral over the weekend, prompting an "eat-in" protest on Saturday and another one planned for this weekend.
