Speaking to reporters after the hearing, Glandian said that motion stems from Smollett's forfeiture of a $10,000 bond previous year when Cook County State's Attorney Kim Foxx's office dropped an earlier set of charges against him.
The Chicago Sun-Times reported that the defense motion filed with Illinois' high court argues that the appointment of the special prosecutor was legally flawed.
Glandian also submitted a motion to the circuit court to dismiss the case based on a double-jeopardy challenge, claiming that Smollett had already been punished in the original case by forfeiting his original $10,000 bond.
