" Au regard du fort impact de ces pratiques sur la concurrence dans la distribution des produits Apple via les Apple Premium resellers, l'Autorité inflige la sanction la plus élevée jamais prononcée dans une affaire (1,24 milliard d'euros)". L'amende au montant exceptionnel de 1,1 milliard d'euros représente ainsi qu'une semaine de chiffre d'affaires pour la firme.

C'est la plus lourde sanction jamais prononcée par l'Autorité, qui a considéré qu'Apple "avait commis un abus de dépendance économique, à l'égard de ses détaillants premium " (spécialisés dans les produits haut de gamme, hors iPhones) une pratique "particulièrement grave" pour le gendarme français de la concurrence. Le groupe californien a fait savoir qu'il ferait appel de cette décision.

Par ailleurs deux grossistes, les sociétés Tech Data et Ingram Micro, ont elles aussi été sanctionnées, à hauteur de 76,1 millions d'euros et 62,9 millions respectivement, au titre de " l'une des pratiques d'entente ".

Elle note aussi que les distributeurs APR n'avaient aucune marge de manoeuvre commerciale et étaient obligés de s'aligner sur les prix des distributeurs intégrés, ce qui a permis à ces derniers et aux Apple Store de dicter leurs prix. Avec pour conséquence un alignement des prix " sur près de la moitié du marché de détail " des produits Apple en France. L'entreprise, partenaire d'Apple depuis une trentaine d'années, gérait quinze boutiques en France. En clair, la firme à la pomme a favorisé ses propres magasins et certains grossistes, au détriment d'autres revendeurs agréés. En outre, lors de certains lancements de produits phares, les magasins indépendants étaient moins bien approvisionnés que les Apple Stores, a constaté l'Autorité de la concurrence. Apple a ainsi " exploité abusivement la dépendance économique de ces distributeurs "premium" à son égard, en les soumettant à des conditions commerciales inéquitables et défavorables par rapport à son réseau de distributeurs intégrés ", continue le communiqué de l'ADLC. " Tout a été fait pour nous mettre dans cette situation ", avait alors confié le P. -D.G.de l'entreprise aux Échos.

Le distributeur, qui employait 130 personnes, avait déposé plainte pour concurrence déloyale, abus de position dominante et abus de dépendance économique, après que le géant américain a décidé l'approvisionner de moins en moins en produits.
