A federal judge in NY has dismissed a class-action lawsuit brought against Major League Baseball by a group of daily fantasy sports players, who claimed to have been harmed by the Houston Astros and Boston Red Sox sign-stealing scandals. "But did the initial efforts of those teams, and supposedly Major League Baseball itself, to hide these foul deeds from the simple sports bettors who wagered on fantasy baseball create a cognizable legal claim?"

"A sport that celebrates 'stealing, ' even if only of a base, may not provide the flawless encouragement to scrupulous play", Rakoff wrote. But as Frank Sinatra famously said to Grace Kelly (in the 1956 movie musical High Society), "there are rules about such things".

Although both teams "shamelessly" used electronic devices to steal signs, U.S. District Judge Jed Rakoff in Manhattan said statements by the teams and baseball commissioner Rob Manfred about the sport's integrity did not make them liable to DraftKings participants who wagered on tainted games. Manfred fined the Astros $5 million, the maximum under Major League Baseball rules and stripped the team of its next two first- and second-round draft picks. In 2017, the Sox were fined in 2017 for their use of an Apple Watch as part of a sign-stealing scheme.

Sign stealing is not against Major League Baseball rules, but using electronics to steal signs is a violation.
