The lawsuit filed in IL state court on Monday by the estate of Wando Evans says the Walmart store south of Chicago was not properly cleaned and employees were not given masks, gloves, antibacterial wipes or other protective equipment.
Evans died on March 25, and another employee at the same store died four days later from complications due to COVID-19, according to the complaint.
Tony Kalogerakos, a lawyer for the estate, said in a statement the lawsuit was the first wrongful death case filed in IL on behalf of a person who has died from COVID-19.
The family of a Walmart worker who died after contracting the coronavirus alleges the retailer's "failure" to implement proper safety and health standards was responsible.
Walmart also hired new workers in an expedited process without properly screening them for symptoms of COVID-19, Evans' estate says. The case also says Evans' coworker, Phillip Thomas, died on March 29. "We take this issue seriously and will respond with the court once we have been served with the complaint".
Last week, the retailer said it would begin checking workers' temperature, offering masks and gloves to workers who want them, and limiting how many shoppers are allowed inside its stores at one time.
The suit contends that Walmart was negligent for the worker's death because it did not adequately clean the store, enforce social distancing, notify employees about co-workers that had coronavirus symptoms, and provide protective gear, CNBC said.
"While many of our customers have been following the advice of the medical community regarding social distancing and safety, we have been concerned to still see some behaviors in our stores that put undue risk on our people", said the company.
