Meghan Markle wins bid to delay court battle with Mail on Sunday

The Duchess of Sussex is bringing a bid to have her privacy action against the Mail On Sunday over the publication of a letter to her estranged father decided without a trial.

Meghan, 39, is suing Associated Newspapers Ltd (ANL), publisher of the Mail On Sunday and MailOnline, over an article which reproduced parts of the handwritten letter sent to 76-year-old Thomas Markle in August 2018.

Judge Mark Warby said on Thursday he had granted the delay for the trial, which was due to have started in London on January 11, until the autumn of 2021.

United Kingdom network ITV's royal editor Chris Ship reports the request for the delay has been prompted by a victory for Associated Newspapers at an earlier hearing, granting them permission to amend their case by arguing Meghan and her husband Prince Harry had cooperated with the authors of a recent biography, which featured the contents of the letter.

At a hearing on Thursday, the duchess's lawyers will ask a High Court judge to rule in her favour and strike out the publisher's defence to her claim.

The judge said other reasons put forward by the duchess's legal team in support of the postponement included Meghan's application for summary judgment - a legal step which would see the case resolved without a trial.

Granting the application to adjourn the trial, Mr Justice Warby said: "The right decision in all the circumstances is to grant the application to adjourn".

A costs and case management hearing, before Judge Francesca Kaye, will also take place on Thursday afternoon.

Sections of the letter were published in the newspaper and online in February a year ago, and it was announced the duchess would be bringing legal action in October. ANL officials deny the allegations and insist they will contest the case.
