Democrats focused their criticism mainly on hate speech, misinformation and other content that can incite violence, keep people from voting or spread falsehoods about the coronavirus.

Democratic Members of the Committee criticized the timing of the hearing, noting that it was six days before the election and could unethically affect the arc of the political debate.

Committee Chairman Roger Wicker opened the hearing by accusing tech companies of implementing an "apparent double standard" under Section 230 to the detriment of conservatives.

Proponents of Section 230 contend that the law is the foundation of free speech on the Internet.

An aide to Senator Ron Wyden, a Democrat from OR who originally co-authored Section 230, said the senator urges caution on steps that could limit free speech online. Critics in both parties say that immunity under Section 230 of the law enables the social media companies to abdicate their responsibility to impartially moderate content.

Cruz pointed out the New York Post is still blocked from tweeting from their account, to which Dorsey responded that the publication can regain access if they delete their original tweet, though he said they can then tweet "the exact same" article again afterward. Zuckerberg said he broadly supports legislative concepts aimed at boosting transparency on companies' content decisions.
