Joe Biden has overturned a controversial ban on transgender people serving in the U.S. military, saying "America's strength is found in its diversity".

It took almost two years, but after a lengthy and complicated legal battle and additional reviews, the Defense Department in April 2019 approved the new policy that fell short of an all-out ban but barred transgender troops and military recruits from transitioning to another sex and required most individuals to serve in their birth gender.

New Defense Secretary Lloyd Austin will be on hand at the White House ceremony on Monday, where the executive order will be signed, said the individuals familiar with the matter.

In 2016, Defense Secretary Ash Carter announced a policy that would allow transgender individuals to serve in the USA military openly.

Former President Donald Trump announced in 2017 that he was reversing an Obama era policy that allowed open military service to transgender people. The plan was implemented later in 2019 after a Supreme Court vote.

The move to overturn the transgender ban is also the latest example of Biden using executive authority in his first days as president to dismantle Trump's legacy.

"I support the president's plan or plan to overturn the ban", Austin said on Tuesday when asked by Senator Kirsten Gillibrand, "I truly believe, Senator, that as I said in my opening statement, that if you're fit and you're qualified to serve and you can maintain the standards, you should be allowed to serve".

Under that policy, now serving transgender troops and anyone who had signed an enlistment contract before the effective date could continue with plans for hormone treatments and gender transition if they had been diagnosed with gender dysphoria.

The policy also disqualified transgender people who had transitioned or required medical transition, citing "considerable scientific uncertainty" and blurred lines "that demarcate male and female standards", according to a memorandum released at the time.
