  • Mossimo Giannulli denied request to serve prison sentence at home by judge

Earlier this month, his attorneys asked that Giannulli be allowed to serve the remainder of his sentence on home confinement.

A federal judge in Boston on Tuesday rejected a request from the husband of actress Lori Loughlin to serve the remainder of his five-month prison term for his role in the Varsity Blues college admissions scandal at home in the couple's Los Angeles mansion, writing that granting such a motion would "undercut" efforts to deter other wealthy people from committing similar crimes.

BOSTON (AP) - Fashion designer Mossimo Giannulli's request to serve the remaining three months of his prison term in the college admissions bribery scheme at home was denied Tuesday by a federal judge. A spokesperson for Giannulli's legal team didn't immediately return an email seeking comment.

"Mr. Giannulli spent nearly 40% of his total sentence confined in solitary quarantine, despite testing negative for COVID-19 at least ten times and despite his counsel's multiple requests that (the Bureau of Prisons) release him from quarantine", his lawyers wrote in a motion filed earlier this month.

Judge Nathaniel M. Gorton on Tuesday denied Mossimo Giannulli's request to serve the remainder of his prison sentence at home, court documents show.

During his time in isolation, they noted that Giannulli was allowed to leave his cell only rarely and that the confinement had taken a toll on his "mental, physical and emotional well-being".

They said the "conditions under which Mr. Giannulli has been incarcerated are far more extreme than what the Court recommended, what BOP be determined was appropriate based on his individual circumstances, or what is warranted by the circumstances of this case".

Lori Loughlin and husband Mossimo Giannulli leave the John Joseph Moakley United States Courthouse in Boston on August 27, 2019.

Giannulli is due for release in April.

Loughlin was released in December after serving her two-month sentence.
