Caron Nazario, who is Black and Latino, filed a lawsuit on Friday in the US District Court against two Virginia police officers Joe Gutierrez and Daniel Crocker for violating his civil rights.
Caron Nazario, 27, who is a black and latino second lieutenant, was pulled over on a traffic stop in the small town of Windsor, Virginia, in December previous year, after officers Joe Gutierez and Daniel Crocker claimed his SUV had tinted windows and no rear licence plate. An officer responded, "Yeah you should be", the suit says. Nazario claims he was simply trying to find a well-lit area to stop in since it was nighttime. Gutierrez acknowledged that Nazario's decision to drive to a lighted area happens to him "a lot, and 80% of the time, it's a minority", Arthur said, quoting the officer.
And while Crocker had radioed he was pulling the vehicle over for not having a license plate, his body cam showed there was a cardboard license plate typically used on new cars posted in the rear window, the complaint says. But according to the lawsuit documents, the SUV had temporary license plate taped to the rear window, which the officers would have been able to see before they even got to Nazario's auto.
Nazario got out of the vehicle and again asked for a supervisor.
Gutierrez then responded, "Yeah, you should be", the complaint said. Gutierrez then stepped back and pepper-sprayed Nazario multiple times as officers yelled for him to get out of the auto. "I'm actively serving this country, and this is how you're going to treat me?" he questions.
According to TMZ, Nazario's dog was in the backseat and suffered from the pepper spray.

Nazario drove his SUV to a well-lighted gas station where, according to the lawsuit, the two officers got out and immediately drew their guns and pointed them at Nazario after they got out of their cars. Nazario was not charged in the incident.
