  • Congressional Democrats Reportedly Plan Bill to Expand Supreme Court

Some House and Senate Democrats are ramping up the political battle over the Supreme Court, introducing a bill Thursday to expand the court from 9 to 13 seats, a move many Republicans have rejected as risky "court packing".

The Democratic bill is led by Sen.

Rep. Jerry Nadler (D-N.Y.) is trailed by reporters following a press conference where he was appointed as one of seven House managers for U.S. President Donald Trump's impeachment trial at the U.S. Capitol January 15, 2020 in Washington, D.C. "But the logic behind having only nine justices is much weaker today, when there are 13 circuits".

"President Biden campaigned on a promise of lowering the temperature and uniting a divided nation", McConnell said in a statement last week.

"For decades, Republicans have rammed radical right-wing justices onto the Supreme Court in a coordinated effort to defend corporate special interests, attack Americans' constitutional rights, and erode our democratic institutions", said Edkins.

Speaking to the Wall Street Journal on Wednesday, Markey acknowledged the bill's long odds and said, "We have work to do to organize, mobilize, and spur Congress to take action to reform the court".

"Our democracy is under assault, and the Supreme Court has dealt the sharpest blows", Jones tweeted Wednesday, pointing to the high court's rulings in Citizens United v. FEC, Shelby County v. Holder, and Rucho v. Common Cause.

The number of Supreme Court justices has remained at nine since 1869, but Congress has the power to change the number and did so several times before that.

Democrats began discussing expanding the size of the highest court in the country court following the death of Justice Ruth Bader Ginsburg when they realized that President Trump would get another chance to install a justice to the highest bench.

Nearly certain to face uniform Republican opposition, the bill falls on the heels of Biden's executive order last Friday empaneling a bipartisan commission to study how to reform the Supreme Court, a study that the president promised on the campaign trail.

"This bill marks a new era where Democrats finally stop conceding the Supreme Court to Republicans", said Brian Fallon, a former Senate Democratic leadership aide and co-founder of reformDemand Justice, describing the court as "broken and in need of reform". Progressives understand we can not afford to wait six months for an academic study to tell us what we already know: "the Supreme Court is broken and in need of reform", Demand Justice Executive Director Brian Fallon said in a statement. "Our task now is to build a grassroots movement that puts pressure on every Democrat in Congress to support this legislation because it is the only way to restore balance to the Court and protect our democracy".
